Terms of Service
These Terms of Service are a binding agreement between you and FTNSS Inc. covering your use of the FTNSS app, website, and services — buying and redeeming day, week, and month passes at partner gyms. By creating an account or using FTNSS, you agree to them. Please read them carefully; they include limits on our liability, an assumption of risk for physical exercise, and how disputes are handled.
1. Acceptance & updates
By accessing or using FTNSS — or by clicking “I agree” where offered — you accept these Terms. If you don't agree, please don't use the service. We may revise these Terms from time to time; when changes are material (those that reduce your rights or increase your responsibilities, including price increases) we'll notify you in the app and/or by email or text at least 30 days before they take effect. Other updates take effect when posted unless we say otherwise, and your continued use means you accept them. These Terms are between you and FTNSS only — not with any partner gym, payment processor, or social platform.
2. Eligibility
You must be at least 18 years old to create a FTNSS account and use the service, and you confirm you can form a binding contract with us. FTNSS is operated from offices in North America and is directed at users in the United States; if you access it from elsewhere, you're responsible for complying with your local laws. You agree not to use the service anywhere, or in any way, that applicable law prohibits.
3. Your account & responsibilities
When you register you agree that: you haven't been previously suspended or removed by FTNSS; the information you provide is accurate and kept up to date; you'll keep your username and password confidential and not share them; you'll tell us immediately about any unauthorised access; and you understand that use of the service is at your own risk, including exposure to content others post that you may find objectionable.
4. Prohibited conduct
Don't interfere with or disrupt the service. In particular: don't circumvent or disable security features; don't scrape or systematically extract data (bots, crawlers, data-mining and similar are not allowed without written permission); don't transmit viruses, malware, or other harmful code; don't attempt unauthorised access to our systems or accounts; don't use the service for any unlawful purpose or to exploit or harm minors; don't reverse-engineer, decompile, or otherwise exploit the service's content; don't send unsolicited promotional content; and don't sell, rent, sublicense, or commercially exploit the service without our written consent.
5. Passes, bookings & gym access
FTNSS sells access to independent partner gyms. A pass grants entry to the specific gym for the period shown at purchase (day, week, or month), valid from the start date you choose. Access is subject to each gym's hours, capacity, house rules, and any waiver they ask you to sign at check-in. We don't operate the gyms and can't guarantee that specific equipment, classes, or facilities will be available. You may transfer remaining, unused days of a purchased pass to another FTNSS user within the app; any transfer made outside these Terms is void.
6. Payments, refunds & subscriptions
Payments are taken at the time of purchase through our third-party payment processor; we can only support the regions and payment methods the processor supports, and prices are shown in your local currency where available. Except where the law requires otherwise, payments are refundable only within 24 hours of purchase, and refunds are handled by the payment processor. Where FTNSS offers auto-renewing passes, they renew for the same term until you cancel; you can cancel anytime in your profile settings, and cancellation doesn't entitle you to a refund of payments already made. Amounts owed to partner gyms are remitted via the payment processor. FTNSS Cash is promotional account credit, not money: it is redeemable only on FTNSS toward eligible passes, has no cash value, is non-transferable, and cannot be withdrawn, sold, or exchanged for cash. FTNSS Cash may expire (currently 12 months after it is earned). FTNSS Cash earned through our referral program is credited to a referred member when they create an account, and to the referring member only once the member they referred completes their first paid booking — one reward per referred member. We may change, suspend, or end FTNSS Cash, the referral program, or any reward amounts at any time, and may withhold or revoke credit we reasonably believe was obtained through fraud, abuse, duplicate accounts, or error.
7. Reviews & content you post
FTNSS may let you rate and review gyms and post photos, text, or other material (“user content”). You're responsible for what you post and you grant FTNSS and other users the rights needed to display it within the service. Keep contributions relevant, honest, and respectful: no threats, harassment, hate speech, or bigotry; no sharing others' personal information or close-up images without consent; no fake, copied, or AI-generated reviews; and no reviewing businesses you're connected to. We may screen, edit, remove, or restore content at our discretion, and user content doesn't necessarily reflect our views.
8. Intellectual property
The service and its content, features, and design are owned by FTNSS and its licensors and are protected by intellectual-property laws. Partner-gym content uploaded to the service stays owned by the gym, but by uploading it the gym grants FTNSS a perpetual, irrevocable, non-exclusive license to use it. Nothing here gives you the right to use the FTNSS name, logo, or brand. If you send us feedback, you grant us a perpetual, irrevocable, royalty-free license to use it.
9. Partner gyms & third parties
The service links to and relies on partner gyms and other third parties (including our payment processor) that FTNSS doesn't control and isn't responsible for. We provide these links and integrations for convenience — review each one's own terms and privacy policy. Where you use a third-party feature through FTNSS, you agree we may share the information needed to provide it. Obligations among FTNSS, gyms, and third parties are several and not joint: no party is liable for another's acts or omissions.
10. Assumption of risk & waiver
Physical exercise and using gym facilities carry inherent risks — including injury, cardiovascular events, strains, and equipment accidents. By using FTNSS to access gyms, you voluntarily assume all such risks, including those arising from other participants, equipment condition, or facility design and maintenance, and you release FTNSS, its affiliates, partners, and the associated gyms from claims arising from injury, property damage, death, or other loss. FTNSS provides no medical advice — consult a healthcare professional before starting any exercise program. This summarises the full Liability Waiver you agree to when you use the service.
11. Disclaimers
Except as expressly stated or required by law, the service is provided “as is” and “as available” without warranties of any kind. We don't warrant the accuracy or reliability of user content, any gym waiver (which is solely between you and the gym), the service's features or availability, or any third-party site or service. To the fullest extent permitted by law, FTNSS disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Your use of the service is at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, FTNSS and its officers, directors, employees, and agents won't be liable for any indirect, incidental, punitive, special, or consequential damages — including lost profits, goodwill, or data — arising from the service, including personal injury or property damage at a gym, unauthorised access, service interruptions, malicious code, or user content. Our total liability for any claim is limited to the amount you paid in the twelve months before the event giving rise to the claim (or a nominal amount if you paid nothing). Nothing here limits liability that can't be limited by law, such as for fraud or gross negligence.
13. Indemnification
You agree to indemnify and hold harmless FTNSS, its officers, directors, employees, agents, and third parties from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, content you create, your breach of these Terms, or your violation of any law or third-party right. FTNSS may assume the exclusive defense of any such matter, and you'll cooperate. This obligation survives termination.
14. Governing law & disputes
These Terms are governed by applicable law without regard to conflict-of-law rules. Certain disputes relating to your use of partner-gym facilities are subject to the binding arbitration and class-action and jury-trial waivers set out in the FTNSS Liability Waiver. We're finalising the unified governing-law and dispute-resolution terms; the controlling version will be posted here, and the “last updated” date above will change when it is.
15. Termination
You can stop using FTNSS at any time by deleting your account in the app or on the website. We may restrict, suspend, or terminate your access at our discretion — including if we reasonably believe you've breached these Terms or created a risk of harm — and may cooperate with law enforcement where appropriate. On termination, the rights granted to you end, though we may retain certain information as described in our Privacy Policy.
16. General
If any provision is found invalid, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. These Terms are the entire agreement between you and FTNSS about the service and supersede prior understandings. FTNSS may assign its rights and obligations; you may not assign yours without our written consent. The Privacy Policy and Liability Waiver are incorporated into these Terms by reference.
